  • Lystnow has never sold customer information for advertising purposes or profited from displaying third-party ads, and we never will. This has been our policy since we entered the SaaS business market, and we remain committed to it.
  • This Policy outlines Lystnow’s approach to any Personal Data we may collect from you or obtain about you from a third party, who has access to it, and the purposes for which we process your Personal Data as a Controller. It also details your rights concerning our processing of your Personal Data.

    • This Privacy Policy solely applies to the utilization of your Personal Data by us or on our behalf. It does not extend to:

  • Personal Data collected by third parties during your interactions or transactions with those third parties, or your utilization of their products or services (for instance, when you navigate to third-party websites via links and may integrate their services, over which we have no authority).
  • Personal Data is processed, stored, or hosted by us when we act as a Processor on your behalf in delivering our Services. In such cases, the privacy statement of the relevant Customer will apply, and our data processing agreement with that Customer will govern our handling of your Personal Data

  • What information Lystnow collects & how

    • Lystnow has never sold customer information for advertising purposes or profited from displaying third-party ads, and we never will. This has been our policy since we enterWe only gather and retain data that is genuinely required to follow legal procedures. Only in the following scenarios does Lystnow Services gather personal data about you:

  • You choose to submit the data yourself with your consent
  • Lystnow gathers the data automatically; or/and,
  • Lystnow obtains the data from a third party.

    • The following explains several data types that fit into either or each of those three categories:

  • (a). Account signup information: In order to access one or more of our services, you must first create an account with us to sign up. At the time, we ask for information, such as your name, email address, password, company name, and admin name. For security reasons, you will be requested to confirm your email address when you first sign up.
  • (b). Payment processing: When you make a purchase from us for any or all of our Services, the third-party payment processors acting on behalf of respective products will handle your credit and debit card information securely, approved by PCI Compliance.
  • (c). Event registrations and other form submissions: When you (i) register for any event, including webinars, (ii) sign up for our newsletter or any other mailing list, (iii) submit a form to download any product, whitepaper, or other materials, (iv) take part in surveys or contests, or (v) contact customer support, we keep a record of the information you submit.
  • (d). Testimonials: We may use your name and other personal information in testimonials regarding our products and services that you give us permission to post on websites and our social media sites for marketing purposes. You will have a chance to check and approve it before the testimonial is posted from our end. You can get in touch with us at (email address with Lystnow) if you want to change or remove your testimonial.
  • (e). Interactions with Lystnow Services: To improve our services for you and other customers, we may record, examine, and use any interactions you have with us, including chat, phone, and email engagements through our customer service and sales representatives.
  • (f). Device information: We process device-related data (such as model name, Android/iOS version, manufacturer, and other important specifications) to make sure our program works seamlessly in every model by fitting it into a variety of brands and models. It is gathered to guarantee that our program runs well regardless of the mobile device models used by our consumers.
  • (g). Location information : We present it to the administrator as business data using the location information. Additionally, by analyzing the location data that we get from users, we are continuously able to increase location precision. We employ constructive research and development to further process them in order to improve the service by correcting the facts with the user record.
  • (h). Information from fingerprint and facial authentication: When utilizing the mobile app, users may be required to authenticate themselves using their fingerprints, and/or, face recognition before accessing Lystnow's products and services.   • (i). Log data: While a user is utilizing the service, Lystnow gathers operational data. This data is then recorded in log files, which are then utilized to identify program crashes and faults on the specific device.
  • (j). Information from cookies: Through the use of cookies, data, and information about website visitors will be gathered automatically at the time of navigation. It is important to keep in mind that information will still be gathered even if the visitor chooses not to register for our service.

Information from browsing external links & blogs: Some of our website pages may link to other websites as we publish publicly accessible blogs with factual data and those sites are not linked to this privacy policy. In this case, the customer will be solely responsible for sharing or submitting his information on any external sites. Also, our website links to our social media sites, for which, this social media widget may collect your navigational information to set cookies to ensure this widget works properly.
  • (l). Information from social media sites and other publicly available sources: We may gather publicly available information, such as profile information, when you interact with us on marketplaces, review sites, or social media platforms like Facebook, Twitter, LinkedIn, and Instagram, or when you provide feedback or reviews about any or all our products, their features, and services. We have to alert you that even if you remove the information from these sites, it may still be retained by us. Additionally, Lystnow might update or add information on you from other sources that are open to the public.
  • (m). Information from referrals: Your name, email address, and other personal information may have been given to us by someone who recommended any or all of your products and services to you through one of our referral programs. If you would like us to delete your information from our database, please email us at (Lystnow email address). We will only use the information you or someone else gives us for the purposes for which it was intended. This applies to information about you as well as information about them.

    • Purpose for using information & process it on your behalf

  • If you’re using our apps to handle other’s data such as your employees and customers, you’re entrusting the same data to process with us with your best knowledge. Also, if you’re using any of our apps and granting permission to access your contacts, image, and file library, you’re entrusting the data to us.
  • You're responsible to own and share your data. We take responsibility to protect it, limit access to it, and process it following your instructions. You can access it and share it in third-party integrations. We hold the data as long as you choose Lystnow services.

    • At Lystnow, we may use your information for the following purposes:

  • To reach you (such as through email) and share information about products you have downloaded and services you have signed up for, as well as to inform you about changes to this Privacy Policy, the Terms of Service, or other important notices.
  • To set up and maintain your account, and to perform all necessary tasks for providing our services, such as enabling collaboration and backing up and restoring your data.
  • To detect and prevent fraudulent and other illegal activities, to report spam, and to protect the rights and interests of Lystnow, our users, third parties, and the public.
  • To keep you informed about new products, features and services, upcoming events, exclusive offers, promotions, and other information that may align with your interest.
  • To invite you to participate in surveys or to solicit feedback on our products, features and services.
  • To understand how visitors navigate our website or app and interact with our products and services to understand what they are seeking and better assist them.
  • To update and analyze our customer data from time to time, to improve marketing campaigns and provide relevant suggestions to users.

    • Who do we share your information with

    Your data with Lystnow reaches the respective authority to maintain the hierarchy and seamless flow of the work. However, this data won’t be shared with another user or platform, and otherwise, the admin grants permission to do so. We share and disclose your information to:

  • (a) Admins and independent authorities: We may provide access and ensure the security of your service data to our individual, specific, and authorized people or admin of the Lystnow group of entities who are involved in providing the service. The purpose is to,
  • identify, examine, and resolve errors
  • verify emails to control spam detection, and
  • authenticate your image, facial, and fingerprint data.
  • provide admin access to modify user information as required.
  • (b) Third-party integrations that you have enabled: Most of our products support easy and quick integrations with third-party software and services. At the time of the integration process, you’re sincerely allowing those platforms to access and utilize your personal details. We always encourage you to check and understand the privacy practices of third-party software before you enable interrogations with them.

    • Legal bases for collecting & using your information

  • (a) The basis for legal processing that applies to Lystnow: The majority of our data collection and processing operations are usually justified by
  • contractual requirements,
  • legitimate interests of Lystnow or a third party that do not conflict with your data protection rights, and/or,
  • your consent.

    • We could occasionally need your personal information to safeguard your essential interests or we might be legally obligated to gather your information.

  • (b) Withdrawal of consent: You have the right to withdraw your consent at any moment when we use it as the legal foundation, but doing so won't change the processing that is currently underway.

    You have the following rights regarding the information that Lystnow Services holds about you:

  • (i) Right to access: You are entitled to view the types of personal information we have about you, including its source, use, duration of processing, and the people it is shared with. If additional copies are needed by you, a reasonable fee may be charged.
  • (ii) Right to rectification: If we have any outdated or incomplete information about you, you have the right to have it updated or corrected. Depending on the purpose of the information, you can instruct us to add more valid details about you to our database.
  • (iii) Right to erasure: You can request the deletion of your personal information under certain conditions, such as when it is no longer necessary for the original purpose of collection.
  • (iv) Right to restrict data processing: You may request that we limit the use of your information under certain circumstances, such as when you have objected to our data usage but we need to verify and ensure whether we have overriding legal grounds to use it.
  • (v) Right to data portability: You have the right to transfer your information to a third party in a structured, commonly used, and machine-readable format, in situations where the information is processed with your consent or by automated means. This does not necessarily mean we will stop storing your Personal Data, but if we do retain it, we will inform you if we lift any restriction on its further processing.
  • (vi) Right to object: You can object to the use of your information in certain circumstances, particularly if we are:
    • relying on our or someone else’s legitimate interest to process your Personal Data, unless we can show compelling legal grounds for the processing; or
    • using your Personal Data for direct marketing purposes.
  • (vii) Right to withdraw consent: If we have collected and processed your Personal Data with your consent, you can withdraw your consent at any time. This withdrawal will not affect the legality of any processing conducted before the withdrawal, nor will it impact the processing of your Personal Data based on lawful grounds other than consent.
  • (viii) Right to opt-out of marketing communications: You have the right to opt out of marketing communications at any time by clicking on the “unsubscribe” or “opt-out” link in our marketing emails.
  • (ix) Right to automated decision-making and profiling: Unless it's required to carry out a contract between you and us, you have the right to refuse to be the subject of a decision that is exclusively based on automated processing, including profiling, if it has legal or similarly significant effects on you.
  • (x) Right to complain: If you have any grievances regarding how we collect, use, or share your information, you have the right to file a complaint with the appropriate supervisory authority. This right may not be available if there is no supervisory authority for data protection in your country.

    • Data retention

    At any cost, it’s not possible to restrict your shared information, collected by our end, however, the admin can customize the data whenever needed. If the user/admin is restricting us from providing information on any of our software products, it’ll be considered only if they discontinue our service from their end.

    Uninstallation of our software and discontinuation of our service will not delete, anonymize, or isolate your information from our active database. This information may be used in the future for follow-ups, analysis, and any other business interests.

    How Secure Your Information with Lystnow

    At Lystnow, we take security measures very seriously as we respect one's privacy. That’s why we use appropriate technical, administrative, and organizational measures to safeguard your personal data and integrity that we preserve and process with our internal and external service providers.

    As security risks are always evolving and so are the controls, we’ll investigate where appropriate against unauthorized access, use, modification, disclosure, or destruction of your entrusted information with us. Also, we’ll notify those people whose sensitive information is compromised to implement reasonable steps in accordance with legal compliance.

    Rights to Data Modification

    The admin panel can access, share, add, copy, modify, delete, and withdraw data if he/she faces an instance to do so to continue fair practices without granting permission from the developer. However, the users won’t be allowed to do the same until the admin’s permission under any special circumstances.

    Legal Actions

    We ensure your belief with us not to share your information without and after withdrawing your consent for any third-party advertising services. However, we may have to disclose your personal data to the respective authorities and in this case, you’ll be informed about it through email or prominent notice within the given time frame. When we don’t intend to, yet, if we sell, get acquired, or merge our business, we ensure legal practices to honor our commitment to you.

    Updates of Changes in Privacy Policy

    As Lystnow is a unified tech-savvy SaaS platform full of innovative and useful software, changes and modifications will be constant for a smooth working infrastructure. We suggest our beloved users check updates periodically to stay aligned with the fresh privacy policies. If the users find different opinions and confrontation with our privacy policies, they can willingly make a choice to deactivate or discontinue with us.

    Enforcement of Our Rights

    We may disclose your personal information or service data if we find it ultimately necessary to prevent fraud, spam filtering, and suspicious or unethical activities to enforce our agreement or privacy policies or protect the safety of our users.
